MEDIATION
Both Glynis and Sushma believe that negotiation is a better
way to resolve disputes that can arise in family law. They
aim to deal with matters collaboratively and will only
resort to court proceedings where there is no alternative.
Sometimes, people going through the turmoil of divorce or
relationship breakup want the opportunity of sitting down
together with an independent third party such as a trained
mediator to discuss finances or the arrangements for the
children. This can help the parties to communicate more
effectively and in some cases can lead to agreement being
reached about finances or the care of the children. Perhaps
more importantly, mediation can sometimes help to ensure
that family relations remain amicable post divorce.
Glynis and Sushma have developed strong and complementary
links with local mediators throughout Leicester. If their clients wish to explore
mediation as an option, Glynis and Sushma will advise about
the process and the cost and will sort out the referral to
the trained mediator on behalf of their client.
Mediators do not give advice on legal matters. Therefore, if
agreement is reached with the help of the mediator, the
mediator will suggest that the client goes back to Glynis or
Sushma to receive legal advice about the agreement and how
it can be given legal effect. With the consent of the
client, the Solicitor will be sent a copy of the agreement
by the mediator which cuts down on legal costs and time. If
for whatever reason mediation does not lead to agreement
between the parties, then Glynis and Sushma once again take
over the case on behalf of their client and deal with it in
the usual way through legal process.
